Release of Deposits

In a recent first tier Tribunal case, consideration has been given to whether a tenant can rely on assurances given by a residential letting agent when seeking to have their deposit returned.

The first tier Tribunal have determined that where letting/managing agents provide details of cleaning contractors and give assurances that any problems that arise will be dealt with by themselves, it is fair and reasonable for a tenant to rely on this irrespective of the fact that those cleaning contractors may not clean the property properly, and the tenant may wish for money to be retained from the deposit.

In the case before the Tribunal, it was determined that the tenant should have all their deposit back thus leaving the letting/managing agent to pick up the tab for the additional cleaning works required.
